Transfer Risk Assessment
Evaluation of legal, technical and practical risks in recipient jurisdictions.
Definition
A documented assessment that controllers must perform prior to transfers, analyzing jurisdictional legal risks (e.g., foreign access or national security laws), technical security risks, and practical enforcement risks to data subject rights, and identifying mitigation measures. The regulation requires retention of assessment records and periodic reassessment where destination conditions change.
