Distribution

Transmission or sharing of content across channels or recipients.

How the laws define this

Regulatory standards agree that distribution fundamentally involves transmitting, sharing, or placing content across networks, systems, platforms, or broadcast channels. The primary divergence between these instruments concerns the breadth of actions and entities captured by the rule. The Law on the responsible use of technology in the context of the deepfake phenomenon (PL-x No. 471/2023) targets content transmission and retransmission specifically to assign duties to distributors and broadcasters regarding labelling, creator data retention, and enforcement cooperation. In contrast, the Act relating to distribution of a forged digital likeness; relating to crime and criminal procedure; relating to distribution of a generated sexual depiction; relating to generated obscene child sexual abuse material; relating to teaching certificates; relating to licensing of school bus drivers; relating to civil penalties for an organization that facilitates the generation of child sexual abuse material; relating to social media and minors; and providing for an effective date defines distribution much more broadly to include selling, renting, lending, exhibiting, and ancillary support services like billing.
