Neural Data

Information derived from an individual's brain activity, including but not limited to brain-computer interface outputs, used to infer thoughts, intentions, or mental states.

Information generated by measuring activity of an employee’s central or peripheral nervous system and not inferred from nonneural information. The statute separately bars collection of this data by covered workplace surveillance tools.
