A decision that affects legal rights, access to government services, or imposes costs on citizens or businesses; determination that an AI system is involved in consequential decisions is the threshold for applying enhanced governance, human oversight, and disclosure obligations. Agencies must assess whether an AI system substantially participates in such decisions when seeking COT approval.
