Consequential Decision

A decision that affects legal rights, access to government services, or imposes costs on citizens or businesses; determination that an AI system is involved in consequential decisions is the threshold for applying enhanced governance, human oversight, and disclosure obligations. Agencies must assess whether an AI system substantially participates in such decisions when seeking COT approval.

A decision that materially affects an individual's rights, opportunities, or access to public services; such decisions, when made or influenced by automated systems, trigger heightened scrutiny and governance under the Act. The concept is used to distinguish higher-impact AI uses that require additional policy attention.

Any decision that relates to an individual's access to, eligibility for, or compensation related to education, employment, housing, financial or lending services, insurance, health-care services, or essential government services and public benefits. This explicitly includes determinations affecting a consumer's access, eligibility, selection, or compensation within these critical domains.

A consequential decision is one that materially impacts a consumer's access to, eligibility for, selection for, or compensation in specific covered domains. These domains include education, employment, real estate, financial services, insurance, healthcare, and essential government services.

A decision impacting an individual's access to, eligibility for, selection for, or compensation related to education, employment, housing, financial or lending services, insurance, health-care services, or essential government services and public benefits.

Decisions that have a material legal or similarly significant effect on access to or terms of opportunities and services for individuals. This includes critical areas such as employment, housing, credit, insurance, education, and healthcare, where AI systems can have a profound impact.

Any decision that has a material legal, or similarly significant, effect on the provision or denial to any consumer of critical services or opportunities, such as parole, probation, pardon, or any other release from incarceration or court supervision; education enrollment or an education opportunity; access to employment; a financial or lending service; access to health care services; housing; insurance; marital status; or a legal service.
