DEPICTED INDIVIDUAL

The depicted individual is any person who is portrayed in the media such that the content purports to show them speaking or engaging in conduct. Liability and civil standing under the statute turn on whether the media falsely represents the depicted individual and whether that falsity was known to the distributor or creator.

The person who is portrayed, represented, or otherwise depicted in the synthetic media; in the statute's context this term is used to identify individuals (including candidates or party-affiliated persons) whose consent is required for lawful distribution or whose rights may be implicated by the media's dissemination.

A real natural person whose likeness, voice, or actions are represented in the media and who is falsely portrayed by materially deceptive media; such individuals are recognized by the statute as potential plaintiffs entitled to seek civil relief for harms caused by the deceptive portrayal.

For the private right of action addressing sexually explicit depictions, an individual who appears, as a result of digitization, to be giving a performance they did not actually perform or to be performing in a performance that was actually performed by the depicted individual but subsequently altered in violation of the section.

The individual whose likeness, voice, or other identifying characteristics are used to create or alter deepfake content, and who is the potential victim entitled to criminal and civil remedies under the statute.

The individual whose appearance, voice, or actions are falsely portrayed or represented in materially deceptive media.

The Act defines a 'depicted individual' as an individual in a deepfake who appears to be engaging in speech or conduct in which the individual did not, in fact, engage. This definition is vital for establishing who can claim to be a victim of a deepfake under the law, particularly in the context of civil injunctive relief.

In the context of HB 182, a depicted individual is any person whose image, photograph, likeness, or voice is used in an advertisement or other media in a way that makes them recognizable. This term ensures the law's protections apply to specific, identifiable persons.
