An AI system whose malfunction, biased outputs or erroneous operation could substantially affect individual rights, public interests or critical public services; such systems are subject to stricter obligations including lifecycle risk assessments, testing, certification/registration and heightened oversight.

AI systems identified as having the potential for serious physical or psychological harm to individuals, damage to property, or substantial economic loss. Specific criteria were to be established in regulations, but examples included systems impacting access to services, employment, or critical to health and safety.
