An AI provider whose system or model is incorporated into another provider's downstream AI system.

Upstream Provider refers to an AI system or model provider whose output becomes a component in another provider's downstream AI system. This is particularly relevant for foundation models and general-purpose AI integrated into end-user applications.
EU AI Act Context: The Act recognizes the multi-layer nature of AI development:
- Article 25: Addresses responsibilities when third-party components are integrated
- GPAI provisions: Foundation model providers have obligations that flow downstream
- Information duties: Upstream providers must provide documentation enabling downstream compliance
Upstream Provider Obligations:
- Provide technical documentation sufficient for downstream compliance
- Supply instructions for proper integration and use
- Notify of known risks and limitations
- For GPAI: comply with transparency requirements (Article 53)
- For GPAI with systemic risk: additional safety obligations (Article 55)
Liability Considerations:
- Upstream providers may share liability for defects in their components
- Contracts should clarify responsibility allocation
- Downstream providers cannot fully disclaim responsibility through upstream reliance
