Overview

Definitions

The Order defines essential terms used throughout the programme: "cátedra universidad-empresa" (a structured collaboration between a Spanish university and productive-sector entity/entities as per article 64.2 of Ley 2/2011), subprogrammes (new national chairs; international chairs hosted in Spanish universities), "beneficiario" (the university awarded the grant), "entidad del sector productivo" (private sector partner(s)), "plan of activities" (the multiannual technical and economic programme), and categories of eligible costs. It clarifies that beneficiary universities must host the chair and that at least one productive-sector entity must formally join the chair, guaranteeing its required financial contribution. International chairs are encouraged where at least one foreign collaborator of recognised prestige participates, unlocking a higher maximum grant. The Order is structured to support both fundamental and applied/industrial research streams, co-created with industry partners so as to ensure transfer and exploitation of results while safeguarding scientific independence and academic integrity.

Implementation Framework

The Order structures implementation across two chapters and a detailed annex with the call text. It prescribes the competitive selection process, the documentation required for application (application form, plan of activities, work packages with costs and timelines, letters of commitment from private partners, declarations of compliance), and the mandatory use of electronic channels for submission. Selection criteria combine scientific and technical quality, relevance, expected impact (academic, training, economic), feasibility and cost-effectiveness, and the degree of private sector commitment. Financial management rules prescribe a single advance payment for the total grant, specific rules on eligible expenses (personnel, consumables, equipment, dissemination, subcontracting), and the modality of annual economic justification with auditors' reports. Subcontracting is permitted up to 50% of the aid, subject to prior authorisation in defined cases and to additional documentation requirements. Beneficiaries must publish results and comply with Recovery Plan publicity obligations. The Order aligns grant management with Ley 38/2003 (General Subsidies Law) and its implementing regulations for modifications, justifications, checks and recovery procedures.

Monitoring and Evaluation

Monitoring arrangements include periodic technical and financial reporting, annual justification windows (documents to be submitted between 1 January and 31 March of the year following each annuality), and a set of indicators tied to Recovery & Resilience milestones (e.g. publication and financing milestones in 2023 and project completions by early 2026). The Ministry may institute monitoring commissions and requires publication of award resolutions and beneficiary data in the Base de Datos Nacional de Subvenciones. Evaluation panels are to be composed to ensure expertise and independence; the Order allows appeals and administrative review within the framework set by Ley 39/2015 and Ley 38/2003. Auditors may be required to provide independent reports as part of the economic justification. The Order also mandates mechanisms for preventing and detecting fraud, corruption and conflicts of interest, including the requirement that managing staff sign absence-of-conflict declarations and that the managing body conduct pre-evaluations of institutional conflict risks. Penalties, Liability, and Appeals

The Order establishes sanctions and corrective mechanisms consistent with the General Subsidies Law (Ley 38/2003) and its regulation (Real Decreto 887/2006). Breaches (misuse of funds, failure to meet publicity obligations, non-submission of justifications, inactivity for a full year, infringement of rules on subcontracting or eligibility) may trigger recovery of unduly paid amounts plus legal interest, administrative penalties, termination of grant, and potential exclusion from future public funding. The Order details grounds for partial or total reintegro and subjects beneficiaries to financial control and audit. Decisions on recovery and sanctions are subject to the administrative appeal routes and judicial review provided under Spanish administrative law; beneficiaries may accept a proposed award within ten working days following publication of the provisional list or see their application deemed withdrawn. The Order also notes obligations regarding anti-fraud procedures and compliance with EU financial regulation for funds from the Recovery and Resilience Facility.

International chairs are foreseen with higher ceilings where non-Spanish prestigious partners participate, promoting cross-border collaboration and knowledge exchange.
