The National Artificial Intelligence Strategy (ENIA) sets Spain's national policy framework for AI, published in December 2020, allocating an initial public investment of approximately EUR 600 million (2021-2023). Summary

The Estrategia Nacional de Inteligencia Artificial (ENIA), published by the Government of Spain in December 2020, is a whole-of-government strategic document establishing priorities, funding and institutional arrangements to promote responsible AI research, deployment and governance across the Spanish economy and public administration. ENIA links its ambitions to the EU policy context, the Spanish Digital Agenda and the Recovery, Transformation and Resilience Plan (NextGenerationEU) and designates the Secretaría de Estado de Digitalización e Inteligencia Artificial (SEDIA) as the coordinating authority for implementation and monitoring. The strategy sets out a package of 20 measures implemented through 6 axes, backed by an initial public allocation of around EUR 600 million for 2021-2023 drawn in part from EU recovery funds, and by public-private instruments (e.g., the Next Tech Fund) to mobilize additional investment. Key delivered measures include the launch of research missions (e.g., missions in health, agriculture and energy), funding for supercomputing and language technologies (LEIA), the creation of territorial networks of technological specialization (RETECH), and programs for green-by-design algorithms.

ENIA also anticipates the need for governance and oversight mechanisms. It proposes the establishment of observatories to monitor algorithmic impact, the development of a voluntary national quality mark (Sello IA) to certify responsible AI practices, and the creation of regulatory sandboxes to experiment with AI systems in controlled environments. Following ENIA’s publication, Spain advanced toward establishing a domestic supervisory authority: the Government established the Agencia Española de Supervisión de la Inteligencia Artificial (AESIA) by Royal Decree in 2023 with competence to support supervision, advise, and — when empowered by applicable legal frameworks — exercise inspection and sanctioning functions. Overview

The Estrategia Nacional de Inteligencia Artificial (ENIA) was presented by the Spanish Government in December 2020. The strategy explicitly calls for the creation of national oversight capacities: observatories for algorithmic impact, a voluntary national certification mechanism (Sello IA) and an agency for supervision. Spain subsequently advanced the creation of an independent supervisory body by means of Royal Decree 729/2023 establishing the Agencia Española de Supervisión de la Inteligencia Artificial (AESIA), which provides a practical enforcement and coordination node to align national activity with the EU AI framework. Key Focus Areas

Many measures are explicitly designed to be inclusive, aiming to reduce digital and gender gaps while promoting sustainability across deployments.

Implementation Framework

ENIA describes an implementation model that combines direct public funding, EU recovery instruments and public-private leverage through funds such as Next Tech. The strategy assigns roles and responsibilities to SEDIA for coordination, to sector ministries for sectoral roll-out, and to research agencies (e.g., Agencia Estatal de Investigación and CDTI) for R&D grants. Territorial agencies and RETECH projects coordinate regional ecosystems. Implementation relies on calls for proposals, co-funded missions, procurement frameworks for public administrations, and pilot/regulatory sandboxes to test novel AI systems under supervision. The plan also foresees the progressive operationalisation of oversight functions and voluntary certification schemes and encourages standards development and participation in international technical and governance fora.

Monitoring and Evaluation

ENIA was designed as a living document with built-in monitoring and review. The strategy commits to periodic reporting, dashboards of funded projects, and evaluation metrics tied to investment execution, adoption rates in public administration and industry uptake. Spain integrated ENIA’s measures into the Recovery Plan reporting mechanisms and committed to review the strategy within approximately two years of publication. Monitoring uses interministerial reporting, external advisory councils and specific observatories (for language, algorithmic transparency and vulnerable groups) to track social impact, investment outcomes and compliance trends. The strategy also emphasises knowledge dissemination and the creation of evidence to inform regulatory updates.

Penalties, Liability, and Appeals

As a strategy, ENIA itself does not establish penal sanctions; instead it sets the groundwork for future regulatory and supervisory instruments. The enforcement dimension was later realised through the establishment of AESIA via Royal Decree 729/2023, enabling inspection, supervision and sanctioning tasks in application of national and European rules where those rules provide for penalties. ENIA also anticipates conformity, certification (Sello IA) and alignment with the forthcoming EU AI Act; liability and redress will be addressed in sectoral regulations and in the transposition and national implementation of EU legal obligations. The strategy underlines the need for transparent appeals processes, accountability documentation and cooperation with data protection and sectoral regulators in adjudicating disputes.

Relationship to Other Instruments

ENIA is explicitly connected to Spain's broader digital policy architecture: the Recovery, Transformation and Resilience Plan, the España Digital agendas and previous R&D&I AI strategies. It references the national RDI strategy in AI (2019) and is implemented through components of the Recovery Plan. ENIA also coordinates with sectoral regulations (health, finance, employment), data protection law (GDPR and the national data protection framework) and national cybersecurity strategies. ENIA informed subsequent instruments such as the regulatory sandbox framework and the creation of AESIA, which operationalise the strategy's supervisory and enforcement ambitions.

International Alignment

From its inception ENIA emphasises alignment with EU policy and international standards. Spain positioned ENIA to harmonise with the evolving European AI regulatory framework and adopted collaborative initiatives including participation in European sandboxes and research partnerships. The strategy advocates international cooperation on standards, ethics and data governance and seeks to leverage EU funding instruments. Spain has also engaged multilaterally with UNESCO, OECD and EU bodies to ensure ENIA’s measures align with international recommendations for trustworthy AI and human-rights respecting governance.
