Definition
Hiring Algorithms (also called Employment AI or HR AI) refers to AI systems used throughout the employment lifecycle—from job advertising and candidate screening to interviewing, hiring decisions, task allocation, performance monitoring, and termination decisions.
EU AI Act Classification: Employment AI is comprehensively regulated as high-risk under Annex III(4):
- (a) Recruitment and selection, including job ad targeting, screening, filtering, and evaluation
- (b) Decisions on promotion, termination, task allocation, and performance monitoring
High-Risk Requirements:
- Bias Testing: Training data must be tested for discriminatory outcomes across protected characteristics
- Transparency: Candidates/employees must be informed of AI use
- Human Oversight: Human review of consequential decisions
- Record Keeping: Audit trail of all AI-influenced decisions
Jurisdictional Variations:
- EU: High-risk classification; GDPR Article 22 applies to solely automated hiring decisions
- NYC: Local Law 144 requires bias audits for automated employment decision tools (AEDTs)
- Illinois: AI Video Interview Act requires consent and disclosure for AI analysis of video interviews
- Colorado: SB 21-169 applies to insurance, with broader AI bills pending
